Shaver and Zandra Anderson will be in Austin representing us. If you can't

SB 411 is back in committee for amendments after being pulled from the
Senate Floor Calendar thanks to your earlier opposition. The proponents of
this bill are making another attempt to send it back to the Senate Floor.
Let the entire committee know it is the same bill with the same problems and
that we have NOT forgotten about
this.
Tell them we want a first offense to be a misdemeanor, not a felony and NO
breed specific legislation.

To the Honorable Senate Criminal Justice Committee:
HB1355 (SB 411) which is to be heard by your Criminal Justice Committee
(5/8/07) is the same bill that has already been considered in the Senate and
which was sponsored by Sen. Shapleigh.
There is nothing new about this bill and still has the same problems as
before. I am against HB 1355/SB 411 as written because:
1. The punishments are too harsh and out of line with other crimes;
2. The wrong definition of "serious bodily injury is used"--should be the
Penal Code definition, not the civil law definition because as written of
the 6 Million Texas dog owners, every one of them could become a felon;
3. The bill should focus on prevention rather than being so harsh and have a
prohibition on loose dogs that is enforced;
4. There should be exceptions for dogs that are legally off their owner
premises like for working dogs on a ranch, hunting dogs or dogs in
sanctioned shows or competitions, which is like the exception given for
assistance dogs; and
5. Sec. 822.007 should be deleted so that any breed specific suggestions can
be avoided.
I am also against any law that is Breed Specific. I am opposed to the
addition of targeting any breed or breeds in this bill. All dogs and their
owners should be treated equally under our laws.
I urge you to vote against HB1355/SB 411. Thank you.

CITY OF LOS ANGELES, CALIFORNIA City Council Agenda for its full
meeting on Wednesday, May 9, starting at 10 a.m., Item 27 "REQUEST
the City Attorney, with the assistance of the Animal Services
Department, to prepare an ordinance to mandate the spaying and
neutering of domestic cats and dogs by the time the pet is four
months old, with specific exceptions for licensed breeders,
consistent with provisions of AB 1634
" Since this is a request to
draft and not an actual draft ordinance, this likely will be an
extended process since the state bill would still be subject to
further amendment for some time. The City Attorney's office drafting
approach has always limited ordinance revisions as much as possible
rather than attempting broad revisions throughout the animal
provisions like the City of San Jose proposal. The referenced
exceptions for licensed breeders currently included in AB 1634
requiring a local business license and federal taxpayer number for
the breeding business are not consistent with the City's existing
breeding permit so would require additional drafting to accomplish
that.
By starting its local drafting process this early, the City would
probably be in compliance by the effective date of AB 1634 (should it
be enacted) of April 1, 2008. Because some of the 536 local
California jurisdictions already have unaltered permits that are LESS
restrictive than would be required by AB 1634, owners holding these
pre-AB 1634 intact permits from the effective date until the end of
2008 would be in compliance with the new state requirement until the
pre-1634 permit expires or January 1, 2009, whichever occurs first,
at which time a post-1634 intact permit would be required. This
provision of Article 2 (e) of the bill has led to the mistaken
conclusion that no permits would be allowed in 2009. Rather, this is
merely an accommodation for holders of pre-1634 local intact
permits. The practical interface between this type of state mandate
on existing local ordinances and procedures will pose many practical
issues if integrated into existing procedures. For example, some
jurisdictions offer 3-year licenses running with individual rabies
vaccination expiration, so that an owner whose license could have
years to run would have to obtain the post-1634 intact permit
covering a different period from the basic license and then renew the
1634 permit annually separate from the license.

HUMBOLDT COUNTY Board of Supervisors May 1 tabled indefinitely
consideration of the Sheriff's Department proposed ordinance
requiring mandatory spay/neuter of dogs and cats not registered with
an approved registry. This was based on the Lake County model that
does not have a permit process for those exempted. However, the
Humboldt County Board did not reject the concept but merely deferred
further action pending outcome of AB 1634 and resolved to endorse the
bill.

CA AB 1634, the "California Healthy Pets Act" is now in the Assembly
Committee on Appropriations with a hearing date is expected to be
Wednesday, May 16. The bill was amended again on April 30, limited
to technical items.
All letters should now reference the last amended version in a
caption.
The Appropriations Committee addresses only FISCAL issues. These
include new costs related to a bill as well as loss of revenue.
Organizations and businesses will be able to provide specific revenue
loss projections, but the very goal of exclusionary mandatory
sterilization permits is to REDUCE the number of unaltered licenses
and thus revenue from licensing in the hope of eventually realizing
cost savings for animal shelter operations and facilities.
AB 1634 would not be simply a law applying to dog and cat owners but
is a mandate on the 536 California local governments to enact and
implement a permit to possess an unaltered dog or cat over 4 months
that MUST meet the minimum standards of the bill but MAY BE MORE
RESTRICTIVE than the bill's requirements. No current local
jurisdictions would currently meet all the bill's requirements.
Because every local ordinance would need to be revised, there is no
way for any person to be assured they would qualify for a specific
permit regardless of cost.

declined to re-appoint Commission on Animal Control & Welfare Chair
Richard Schulke who had served many years off and on, often grand-
standing with the media on high profile issues such as the original
1999 "guardian" proposal. The reason would have been predictable
only to those who know that in San Francisco, the residential rent
control ordinance and board trump all else including a proposal
referred to the Board to allow landlords to charge 5% of a tenant's
rent per pet as an incentive to open more housing to pets. Rules
Committee Chair Aaron Peskin had been one of the votes against the
guardian proposal when it finally passed in early 2003. Two other
commissioners who had supported this rent control exception were also
denied re-appointment.

preemption modification) "or any other law". The meaning of this
amendment raises more questions about the interface with existing
permits that are not breed specific yet have provisions differing

* For temporary stays in California, the out of state driver license
reference is deleted and the exemption is left to proof to be
determined by local jurisdictions that "the cat or dog is temporarily
in California for training, showing or any other legitimate reason."

and chooses other paths to curb animal overpopulation.
"The spirit of it is fine. The mechanics of it is a little more
difficult," said Scott Delucchi, vice president of the Peninsula
Humane Society.
The PHS was asked to support the bill, but did not. Instead, it is
choosing to take no official position. The PHS tried unsuccessfully
in the early 1990s to pass countywide legislation to reduce the
number of homeless pets. Now, the organization prefers to focus on
free or low-cost clinics and insists the best way to attack the
problem is county-by-county rather than statewide, Delucchi said.
More than a decade ago, the PHS lobbied each city to pass a law
requiring pet owners who did not fix their pets to pay an additional
$30 to $40 fine if they had to claim their pet from the shelter. Only
a handful of cities passed the legislation, including the city of San
Mateo, Delucchi said.

contact form for "Members" of The American Kennel Club to express
support or perhaps ask questions. (The AKC does not have
individual "members"; only clubs are members of AKC.) No other
categories of opponents are included in this ostensible outreach, and
the new round of amendments makes no effort to address animals that
would not be a "valid" breed of an acceptable registry and either
showing/competing or earning/being trained to earn a title offered by
an approved "purebred" registry. This suggests intent to split the
opposition by undermining unity of the AKC and its registrants and
ignore the remainder of the broad spectrum of opposition.
Also new on the web site are details about free transportation to
Sacramento for the May 16 hearing with a long list of coordinators
and assurance that everyone attending will be able to state their
name, group and position at the Appropriations Committee microphone.

individual "members"; only clubs are members of AKC.) No other
