Shapleigh.<BR><BR>There is nothing new about this bill and still has the same problems as<BR>before. I am against HB 1355/SB 411 as written because:<BR>1. The punishments are too hars
h and out of line with other crimes;<BR><BR>2. The wrong definition of "serious bodily injury is used"--should be the<BR>Penal Code definition, not the civil law definition because as written of<BR>the 6 Million Texas dog owners, every one of them could become a felon;<BR><BR>3. The bill should focus on prevention rather than being so harsh and have a<BR>prohibition on loose dogs that is enforced;<BR><BR>4. There should be exceptions for dogs that are legally off their owner<BR>premises like for working dogs on a ranch, hunting dogs or dogs in<BR>sanctioned shows or competitions, which is like the exception given for<BR>assistance dogs; and<BR><BR>5. Sec. 822.007 should be deleted so that any breed specific suggestions can<BR>be avoided.<BR><BR>I am also against any law that is Breed Specific. I am opposed to the<BR>addition of targeting any breed or breeds in this bill. All dogs and their<BR>owners should be treated equally under our laws.<BR><BR>I urge you to vote against HB1355/

The City Attorney's office drafting <BR>approach has always lim
ited ordinance revisions as much as possible <BR>rather than attempting broad revisions throughout the animal <BR>provisions like the City of <st1:city w:st="on"><st1:place w:st="on"><SPAN id=lw_1178641553_11 style="CURSOR: hand">San Jose</SPAN></st1:place></st1:city> proposal. The referenced <BR>exceptions for licensed breeders currently included in AB 1634 <BR>requiring a local business license and federal taxpayer number for <BR>the breeding business are not consistent with the City's existing <BR>breeding permit so would require additional drafting to accomplish <BR>that. <BR><BR>By starting its local drafting process this early, the City would <BR>probably be in compliance by the effective date of AB 1634 (should it <BR>be enacted) of April 1, 2008. Because some of the 536 local <BR><SPAN id=lw_1178641553_12 style="CURSOR: hand">California</SPAN> jurisdictions already have unaltered permits that are LESS <BR>restrictive than would be required by AB 1634, owners holding these <
BR>pre-AB 1634 intact permits from the effective date until the end of <BR>2008 would be in compliance with the new state requirement until the <BR>pre-1634 permit expires or January 1, 2009, whichever occurs first, <BR>at which time a post-1634 intact permit would be required. This <BR>provision of Article 2 (e) of the bill has led to the mistaken <BR>conclusion that no permits would be allowed in 2009. Rather, this is <BR>merely an accommodation for holders of pre-1634 local intact <BR>permits. These are substantive but <BR>not major amendments including:<BR><BR>* local jurisdiction may waive all or part of penalty if violator <BR>provides verification of sterilization but not if violator "transfers <BR>or abandons" the animal.<BR>* adds wording to intact permit eligibility of demonstration <BR>that "cat or dog is a valid breed that is recognized by an approved <BR>registry or association" and "complies with at least one" of two <BR>conditions sub-sections. These are amended to delete the requirement <BR>that approved registries be in existence by October 1, 2007 with <BR>other re-wording. For qualifying titles, "legitimate" is added to <BR>the default other title. <BR>* adds to the provision not prohibiting a more restrictive program <BR>pursuant to Health & Safety Code Section 122331 (the breed specific <BR>preemption modification) "or any other law". The m

ese are amended to delete the requirement <BR>that approved registries be in existence by October 1, 2007 with <BR>other re-wording. For qualifying titles, "legitimate" is added to <BR>the default other title. <BR>* adds to the provision not prohibiting a more restrictive program <BR>pursuant to Health & Safety Code Section 122331 (the breed specific <BR>preemption modification) "or any other law".
